ALL CANDIDATES with H1b Eligibility; Specialized Occupation Processing Season IS NOW!
If you have missed our initial memorandum last February 1st and the seminar last Friday February 9 about H1b – Specialty Occupation Visa Category, please be reminded and guided that we are now processing H1b Season for those candidates who missed last year’s quota and for those who may be eligible this year for the 2018 – 2019 VISA SPECIALITY OCCUPATION and ALLOCATION.
We have started the process for most cases from change of status from B1/B2 to H1b and / or other categories like F1 to H1b. This is to conform with the ideal 6 to 8 working weeks of processing time beginning February 15 until April 2nd.
Should USCIS use the same random and lottery selection process, we may again anticipate a very early closure of the H1b CAP for this year, it means a few days after April 2nd.or until the first week until USCIS closes the annual cap.
Those with eligibility and are ready to start will be prioritized to ensure that their case’s time line are followed from now until before the filing date.
Basically, we are on a 6 week minimum case processing anticipated period of preparation before the 1st official filing date of April 2nd.
H-1B visas have been the most preferred U.S. employment visa because of its flexibility for professionals to work in “specialty occupations” – this is good for 3 years and renewable for another 3 years, until the company decides to petition the non-immigrant with a permanent-based petition or Green Card.
If you think you have the eligibility to qualify for H1b petition/application or may not be too sure because of requirements, the time to act and prepare is NOW.
United States Citizenship and Immigration Services (USCIS) just announced its dates for 2019 H-1B visa lottery. Every year, there are only 65,000 numbers available for all non-U.S citizens and an additional 20,000 for those who has a US advanced degree.
United States Citizen and Immigration Services announced that Monday, April 2, 2018 is the first day that a petition will be accepted for H-1B status beginning October 1, 2018, if selected and approved.
In more recent years, this was the policy imposed by USCIS on the selection process. After the announcement of the cap, the applications will go through the selection or random system. Yes, it’s not a guarantee that if your application is received, you are immediately selected for processing. Only then will USCIS randomly select application for adjudications. If you are selected, your company will receive a receipt notice. If not, your application will be returned and you may re-apply again the next fiscal year. We hope that the process will be more “fair” this year, but for now, we just have to be more pro-active by preparing ahead.
A lot of you may be qualified, but you are simply unaware or skeptical to ask questions or check your company’s or applicant’s eligibility.
